What are the
terms and conditions for image use?
This is a legal agreement between you and Bill Marsh Royalty Free Photography.
In using the images from the Bill Marsh Royalty Free Photography collection
you agree to be bound by all the terms and conditions of this agreement.
1. Use of Images
All Bill Marsh Royalty Free Photography images are royalty free and model
released. This means the purchaser of the Bill Marsh Royalty Free Photography
CD-ROM is permitted to use the images as many times as needed for as many
projects as desired.
There are limitations:

No Bill Marsh Royalty Free Photography images may be used to harm
the reputation of Bill Marsh Royalty Free Photography or Bill
Marsh Photography.

No Bill Marsh Royalty Free Photography images may be used to harm
the reputation of any models included in the images.

No Bill Marsh Royalty Free Photography images may be used with
the intent to defame any person(s) or group(s) of persons, in
a pornographic/obscene, immoral or fraudulent setting.

No one is permitted to trademark or place any identification on
any Bill Marsh Royalty Free Photography image that would indicate
copyright to anyone other than Bill Marsh Royalty Free Photography.
- Whenever
applicable we would appreciate Bill Marsh Royalty Free Photography
images that are displayed on/in a purchaser's website, publication
or any trade material be displayed with credit to Bill Marsh Royalty
Free Photography, in a visible area, as stated:

All users of Bill Marsh Royalty Free Photography images agree
that Bill Marsh Royalty Free Photography will not be held responsible
for damages, including lost revenue, as a result of using these
images or the Bill Marsh Royalty Free Photography CD-ROMs.

The
purchaser of the Bill Marsh Royalty Free Photography CD-ROM, or any one
else, is not permitted to sell, distribute, give away, lend, or lease any
Bill Marsh Royalty Free Photography images unless they have entered into
an agreement with Bill Marsh Royalty Free Photography.
The terms of use outlined above are in effect until the Bill Marsh Royalty
Free Photography CD-ROM is destroyed, including any copies. The laws of
the country of Canada will govern any disputes related to this contract.
2. Warranty
All Bill Marsh Royalty Free Photography CD-ROMs are warranted to be free
from defects in materials and workmanship, under normal use, for a period
of 90 days from the purchase date, as evidenced by the receipt of purchase.
Any Bill Marsh Royalty Free Photography CD-ROM that is deemed to be defective
will be exchanged with another Bill Marsh Royalty Free Photography CD-ROM
of the same title. No refunds will be permitted.
Bill Marsh Royalty Free Photography can not warranty the images on the
CD-ROM will meet the requirements of the purchaser. All images on the
CD-ROM are available for pre-purchased viewing on the Bill Marsh Royalty
Free Photography website.
3. License Restrictions
All Bill Marsh Royalty Free Photography CD-ROMs are licensed for 5 persons.
The purchaser and four other persons, related to the purchaser by employment
relationship or contract agreement, are permitted to use the disk. No
more than five persons may use the disk at any time, whether the persons
are contractors or employees. The images on the Bill Marsh Royalty Free
Photography CD-ROMs are not to be placed on a server or in an image library
unless the library permits access to 5 or less persons at any time.
Only one copy of the Bill Marsh Royalty Free Photography CD-ROM may be
made for backup purposes. Any further copies will be considered copyright
infringement. Companies that require more than one copy of the Bill Marsh
Royalty Free Photography CD-ROM due to location/usage issues are required
to purchase multiple copies of the Bill Marsh Royalty Free Photography
CD-ROM or share the resources via email/Intranet to a maximum of five
persons at a time.
4. Copyright
By purchasing your Bill Marsh Royalty Free Photography CD-ROM you are
granted copyright privileges to use the images purchased. If Bill Marsh
Royalty Free Photography images are used without purchase, for any purpose,
this agreement is violated and will be pursued via the governing copyright
laws of Canada.

is the scan quality of the images?
All Bill Marsh Royalty Free Photography images have been professionally
drummed scanned for the highest quality possible. Each image has been
cleaned, is scratch free and is print ready.

What resolution is used for these images?
Each Bill Marsh Royalty Free Photography CD-ROM contains 125 high quality
professionally photographed unique and current images in RGB format. Each
image will have two forms:
High Resolution
9" x 12" 300-dpi JPEG
maximum compression file format
Suitable for print work, including full magazine wraps/bleeds
Low Resolution
5" x 7" 72-dpi JPEG
file format
Suitable for web development, quick design and composition

Why are your images in RGB format?
The RGB format provides considerable flexibility by offering a wide variety
of options for output devices and a very broad color gamut output.
The images are easily converted to CMYK for specific paper and press requirements.

Are your images up to date?
Yes, all Bill Marsh Royalty Free Photography images are shot with models
wearing/using the latest in equipment, clothing and accessories. Our current
series will only contain images that are up-to-date and fresh.

Do you use professional models in your images?
In order to insure the most realistic and lifelike shots all Bill Marsh
Royalty Free Photography images are photographed using people who are
experts in their field. You won’t see any hired actors impersonating tradespeople
or fashion models pretending to be professional athletes.

What do I do if my product arrives damaged?
If you receive product that has been damaged in the shipping process simply
repackage the item and return it for exchange within seven business days
of receipt.

What is the procedure for ordering product offline?
Print off and use our Offline Order
Form or email Bill Marsh Royalty Free Photography and state that
you would like to order product offline. A Company representative will
contact you. You must include your name and telephone number.

What is the
benefit to single image purchases?
Single
image purchases are of benefit when you find you are only needing one
or two images on any of our Royalty Free Discs. Instead of having to buy
an entire disc you are free to choose the images you want. The real benefit
is that you can get your images NOW. No mailing involved...which means
no shipping/handling charges to you! As soon as you're order has been
proccessed and approved (may take up to a couple of minutes) you will
be able to download the single images you ordered.

How
will my single image be sent to me?
Once your order has been processed and approved, you will be emailed
a link, along with a username and password, as to where you can download
your image(s). Simply click on the link, enter in your username and password
and you will be taken to the "loading dock" where you can then
download your image(s). Your image will be housed here for 7 days, but
be sure to pick it up promptly.

What is an expired security certificate alert?
If you use a browser older than Netscape version 4.06 or Microsoft Internet
Explorer 4.5 or older for the Macintosh, then entering the Bill Marsh
Royalty Free Photography secure server environment will result in a Certificate
warning.
A prompt will appear:
"One of the Certificate Authorities that identifies this site has expired.
This may be because a certificate authority has actually expired, or because
the date on your computer is wrong."
You will be asked if you wish to cancel the transaction:
Please be assured that you can continue with your purchase - your transaction
will be secure.
This prompt is simply a result of using an older Internet browser. It
is not a problem with the Bill Marsh Royalty Free Photography. It means
that a built-in expiry date in your Internet browser has lapsed. To avoid
